INTERNAL DISPUTES

Bernzomatic filed suit against Worthington on June 10, 2008.  The suit alleges that Bernzomatic was in business since 1876, Western produced the gas cylinders for Bernzomatic for 20 years or more, then after Worthington purchased the manufacturing facility (effective September 17, 2004), Worthington ultimately breached its "supply agreement" with Bernzomatic and took over production and distribution of the gas cylinders under its own label.  At the time of this publication Worthington indeed has its own labels on several MAP gas cylinders (apparently more than 50%).  Bernzomatic's complaint provides a wealth of information with respect to the entities and products.
